Terms
All sales of products and/or services (“Goods”) to customers in Australia and New Zealand at or through zagg.com or affiliated websites (“zagg.com”) are governed by and subject to these sales terms and conditions (the “Terms”). By placing an order or making a purchase through zagg.com, the buyer (hereinafter “Buyer”) accepts the Terms and agrees to be governed by and subject to the Terms.

Refunds & Returns

Online Purchases of ZAGG Products
If, for whatever reason, you are dissatisfied with your purchase, submit a return request within 30 calendar days of purchase for a refund. To be eligible, items must be unused, in resellable condition, and in their original packaging. Due to the custom nature, ZAGG Custom Cases are not returnable and cannot be cancelled once you place your order.

How to Start a Return

  1. Email ZAGG Customer Care at cs_anz@zagg.com or call (1300) 044 523 (Australia) with your order number and the items you want to return.
  2. Our team will confirm whether your items are eligible and send you instructions for shipping them back.

Return Shipping
Return shipping details, including any costs for change-of-mind returns, will be confirmed by our team when your return is approved. If your product is faulty, ZAGG will cover reasonable return costs as required by the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993.

Refunds
Once your returned item is received and inspected, you will be notified by email whether your refund has been approved. Approved refunds are issued to your original payment method.

Non-Returnable Items

  • ZAGG Custom Cases and other custom printed products
  • Select discounted items, where noted at the time of purchase

These exclusions apply to change-of-mind returns only and do not limit your rights under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993 if a product is faulty.

Faulty Products: Customers in Australia
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Faulty Products: Customers in New Zealand
Our goods come with guarantees under the Consumer Guarantees Act 1993 that cannot be excluded. If a product fails to meet a guarantee, you may be entitled to a repair, replacement, or refund, and, where the failure is of a substantial character, to reject the goods. You may also be entitled to compensation for any other reasonably foreseeable loss or damage.

Damaged or Missing Items
Please notify us of damaged or missing items within two business days of receipt of merchandise so we can resolve the issue quickly. This does not limit your rights under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993.

Warranty Claims
For warranty issues during the warranty period, you can return the defective product with your proof of purchase to the store where you bought it for assessment, or request a replacement online (shipping and handling charges may apply). See How to Get a Warranty Replacement for full instructions, or contact Customer Care at cs_anz@zagg.com.

Shipping & Delivery

Shipping Estimations
Orders will ship as soon as practicable from when the completed order is received and payment is processed, unless noted at the time the order is placed or if you receive an email notice that an item in your order has been delayed. Preorders will ship at a future date. Any expected delivery dates that may be given are only estimates. Orders can be delayed due to verification or time of order being placed. Orders may be delivered in separate shipments. Deliveries to regional and remote areas may take additional time.

Shipping Restrictions
Lithium-Based Battery Shipments: Due to standalone lithium-based battery shipping restrictions, this product may only ship via ground and is subject to domestic and international shipping requirements. If the final ship-to address cannot be shipped to via ground, the order may be subject to cancellation. International shipments are also prohibited for products with lithium-based batteries. Orders for customers in Australia ship from our Australian warehouse, and orders for customers in New Zealand ship from our New Zealand warehouse.

Delivery
Expected delivery dates are estimates. All deliveries are subject to modification or cancellation due to events beyond ZAGG’s reasonable control, including without limitation acts of God, compliance with any law, order, rule or regulation of any governmental or other authority, delay in transportation, labour disputes, strikes, failure of equipment or systems, or shortages of any labour or materials or services.

Orders, Cancellations & Pricing

If ZAGG cancels an order after billing, ZAGG will refund the billed amount.

Once placed by the customer, orders made on zagg.com cannot be cancelled. You may return your unwanted, unused product to ZAGG pursuant to ZAGG’s return policy, which may be found here.

If an item purchased for full price goes on sale within fourteen (14) days of purchase, ZAGG will refund the difference upon request. ZAGG does not match prices that appear to be from unauthorised resellers or to be inconsistent with ZAGG’s resale policies. Other Terms

Additional Terms and Conditions may apply to purchases of goods, contests, and promotions, all of which are made part of these Terms. If there is a conflict between these Terms and the terms posted for the specific purchase, contest or promotion, the terms posted for the specific purchase, contest or promotion will govern with respect to your participation or specific transaction.

Australian Consumer Law and New Zealand Consumer Guarantees Act
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), the New Zealand Consumer Guarantees Act 1993, the New Zealand Fair Trading Act 1986, or any other law that cannot lawfully be excluded, restricted or modified. Any limitation or exclusion in these Terms applies only to the extent permitted by law.

Limited Warranty
Any applicable limited warranty is available to the original retail purchaser only and is in addition to your rights under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993. For applicable limited warranty terms and conditions, please review the original packaging or visit our warranty policy.

Limitations on Liability
Subject to the Australian Consumer Law and New Zealand Consumer Guarantees Act section above, and to the maximum extent permitted by law, ZAGG will not be liable for any indirect or consequential loss, including loss of profits, arising from the purchase or use of Goods. Where the law permits ZAGG to limit its liability for a failure to comply with a consumer guarantee, ZAGG’s liability is limited, at ZAGG’s option, to replacing or repairing the Goods or supplying equivalent Goods, or paying the cost of doing so.

Modifications
Any changes to the Terms are binding and enforceable only if made in writing and signed by an authorised ZAGG officer. ZAGG does not agree to and rejects any proposed terms or conditions contained in an order or other documents that are in addition to, in conflict with, or inconsistent with the Terms. ZAGG RESELLERS, AGENTS OR EMPLOYEES ARE NOT AUTHORISED TO MAKE ANY MODIFICATIONS, ADDITIONS OR EXTENSIONS TO TERMS OR WARRANTIES.

Intellectual Property
Buyer acknowledges ZAGG’s ownership of all trademarks, service marks, copyrights, imprints, rights of publicity, patents, design patents, registered designs, industrial designs, trade dress, product design, trade secrets and other intangible rights relating to the Goods (collectively “ZAGG Intellectual Property”) and acknowledges that Buyer will have no right, title or interest whatsoever in any ZAGG Intellectual Property.

Applicable Law
If you reside in Australia, the Terms are governed by the laws in force in the Australian state or territory where you reside. If you reside in New Zealand, the Terms are governed by the laws of New Zealand. You and ZAGG submit to the non-exclusive jurisdiction of the courts of the place where you reside.

Additional Rights
ZAGG has all rights and remedies given to ZAGG by applicable law, and ZAGG’s rights and remedies are cumulative and may be exercised from time to time by ZAGG. No waiver by ZAGG of any Terms shall operate as a novation or waiver of any other breach. ZAGG will not lose any right because it has not exercised that right in the past.

Miscellaneous
If any Term is invalid or unenforceable, that Term will be ineffective only to that extent, but the remaining provisions and Terms will be unaffected. Buyer’s rights may not be assigned or transferred. The Terms will be binding upon and enforceable by and against Buyer and ZAGG, and their respective legal representatives, successors, heirs and assigns.
